Additional Product Terms

Capitalized terms not defined here have the meaning given to them in our Master Subscription Agreement. By using any of the products or features described in this document, you agree to these Additional Product Terms in addition to our Master Subscription Agreement.

If you use the Service to send or receive messages via the WhatsApp Business Platform, you must comply with Meta’s WhatsApp Business Policy and Commerce Policy, obtain proper opt-in consent from message recipients, and only use approved message templates where required. You must honor opt-out requests promptly, in accordance with our Acceptable Use Policy. Your WhatsApp Business Account remains subject to Meta’s terms in addition to ours.

Where the Service includes AI-powered or automated chatbot features ("AI Products"), the following terms apply in addition to the rest of this document.

Input and Output. "Input" means any data, content, and information (including conversation and message data) submitted to an AI Product by you, your authorized Users, or the People you communicate with through the Service. "Output" means the results generated by an AI Product based on the Input, including any actions taken by the AI Product. Input and Output are Customer Data under the Master Subscription Agreement and are subject to the rights, restrictions, and obligations that apply to Customer Data, including under our Data Processing Agreement.

Third-Party AI Providers. AI Products may use third-party AI providers’ technology in addition to ChakraHQ’s own machine learning technology. Any personal data contained in Input processed by a third-party AI provider is processed as a sub-processor under our Data Processing Agreement — a current list of the third-party AI providers we use is available in our Subprocessors List. We contractually restrict our third-party AI providers from using your Input or Output to train their own general-purpose models.

Accuracy. Output may contain material inaccuracies and may not reflect correct, current, or complete information. You must not rely, or encourage others to rely, on Output without independently evaluating its accuracy and appropriateness for your intended use, including through human review. ChakraHQ makes no representations or warranties and provides no indemnities with respect to Output.

Transparency. You will ensure that People are informed that they are interacting with an AI system where the Service is used to communicate with them, that Output is not falsely represented as being human-generated, and that Output is clearly marked as artificially generated where required by applicable law.

Restrictions on Use. You will not, and will not permit others to, (a) use an AI Product or its Output to develop any AI model or product that competes with ChakraHQ or its third-party AI providers, or (b) use any method to extract data or infer information from an AI Product, or otherwise attempt to discover its underlying components (for example, model parameters, algorithms, or prompts), except to the extent such a restriction is contrary to applicable law.

Access to ChakraHQ’s APIs is subject to applicable rate limits and authentication requirements. You may not use the APIs to build a competing product, to circumvent usage limits, or for any automated access not expressly authorized by ChakraHQ.

Certain add-on products or features may carry separate fees and billing cycles, as described at the time of purchase. Unless otherwise stated, such fees are non-refundable and billed in advance.

The Service may integrate with third-party platforms and services. Your use of any third-party integration is also subject to that third party’s own terms and policies, and ChakraHQ is not responsible for the availability or performance of third-party services.

Certain features described in this document may be in beta or limited availability, and are provided "as is" without warranty of any kind, and may be modified or discontinued at any time.

In the event of a conflict between these Additional Product Terms and the Master Subscription Agreement (or the Website Terms of Use, where applicable), these Additional Product Terms shall govern with respect to the specific products and features they cover.
